Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 

ONLINE STORE TERMS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. 
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. 

DESIGN SERVICE

 By using Bonmatch Design Services, you agree you are solely responsible for the images you submit to us for the Custom Designed Product. You grant us a fully paid, worldwide, non-exclusive right and license to use your owned or licensed copyrights, logos, insignia, trademarks, and other artistic designs contained in the images submitted to us for the purpose of providing the Custom Design Services and the Custom Designed Product. Bonmatch may use third-party software to assist with the collection and curation of your images and reserves the right to keep your images and any revisions and/or the final version of your Custom Designed Product as a record of work completed.

As a user of Bonmatch’s Custom Design Services, you agree to the following program policies:

A. Curation Fee .Once a Bonmatch Designer receives any customers images, the work process will be considered as started and any corresponding curation fees are non-refundable.

B. Curation Fees. Any fees collected by Bonmatch  are non-refundable. If a customer chooses to abandon the Design Service  after Bonmatch has collected the payment, these fees will be converted as a Credit governed by these Terms.

C. Revisions Policy. Two rounds of revisions are included in Free Design Service. Each additional round of revisions will incur an additional $50 revision fee.

D. Custom Designed Product Errors and Replacements. Upon receipt of your final Custom Designed Product, you are responsible for the final checkout and review of the Custom Designed Product within the Bonmatch online shopping cart. It is your responsibility to perform a final proof of your Custom Designed Product for any spelling, date, alignment, or other related issues before the Custom Designed Product order is completed and sent for printing. Custom Designed Products will only be considered for replacement if there are printer-generated physical defects in the final, delivered Custom Designed Product. For avoidance of doubt Bonmatch’s sole liability for a Custom Designed Product is replacement of a Custom Designed Product in the event of a printer-generated physical defect in the final, delivered Custom Designed Product.

E. Changes to Custom Design Services. Pricing and level of services included in the Custom Design Services is at the sole discretion of the Bonmatch team and is subject to change at any time. Changes to the Custom Design Services program will be updated in these Terms. You agree to be bound by the version of the Custom Design Services policies in place on the date on which your Custom Design Services began.

F. Bonmatch may offer Curation Service promotions, including free or reduced rate Curation Service fees. Services provided during these promotions are at the sole discretion of the Bonmatch team and at no point can any free or discounted Curation Service rates be applied to other Bonmatch products or services.
By enrolling in a free or reduced rate Curation Services program, you are subject to these terms.

GIFT CARDS

These following addition terms apply specifically to the purchase and use of BONMATCH gift cards (“Gift Cards”):

1. Purchasing and Using Gift Cards: BONMATCH offers Digital Gift Cards that can be purchased and redeemed through the Bonmatch Website (www.bonmatch.com). Purchasing or using Gift Cards establishes acceptance of Bonmatch Terms of Services. You may not purchase or redeem a Gift Card without having access to the Internet and creating an BONMATCH account. Gift Cards provide a gift code containing a redeemable monetary value, credited to an order when entered during the checkout process.

2. Account Balances: The holder of the Gift Card can review the Gift Card’s balance by entering the respective Gift Card code into the designated inquiry location on the BONMATCH website, or by contacting our Service Center(bmservice@bonmatch.com)

3. Limitations: Gift Cards may be redeemed through the BONMATCH website only. Gift Cards are non-refundable and may not be used toward previous purchases. Every permitted purchase made with a Gift Card, plus applicable costs, such as shipping and handling and taxes, is deducted from the Gift Card balance. Gift Card balances will be applied against the total amount of the order placed. Any unused Gift Card balance will remain on the Gift Card. If any purchase exceeds the Gift Card balance, the excess amount must be paid with another payment method accepted on the Website. Gift cards balances cannot be used to purchase other gift cards or certain other items as specified on the Website. Gift Cards are valid only for residents of the United States.

4. No Expiration Date or Fees: Gift Cards have no expiration date and BONMATCH does not charge any fees for Gift Cards.

5. Restrictions: Gift Cards cannot be reloaded or recharged, and balances on multiple Gift Cards cannot be combined into a combined balance on one or more new Gift Cards. Gift Cards cannot be used to purchase other gift cards. Except as required by law, Gift Cards may not be transferred, resold or redeemed for cash or checks, and Gift Card balances cannot be transferred to credit card accounts or accounts of other means of payment. Unused Gift Card balances in an BONMATCH account may not be transferred to another BONMATCH account or split among multiple accounts. If applicable law requires us to redeem Gift Cards for monetary value BONMATCH reserves the right to pay by any means we choose (e.g., cash, check).

6. Fraud: If we believe that a Gift Card is used, redeemed or obtained fraudulently, BONMATCH reserves the right to reject the redemption or use of the Gift Card, bill alternative forms of payment, terminate the applicable account, and/or take available legal actions.

7. Risk of Loss: The risk of loss and title for Gift Cards pass to the purchaser upon purchase. You can report misplaced Gift Cards by contacting bmservice@bonmatch.com, but we are not responsible if any Gift Card is lost, stolen, destroyed or used without your permission.

8. Limitation of Liability: We make no warranties, express or implied, with respect to gift cards, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purposes. In the event a gift card does not function properly, the sole remedy, and our sole liability, will be the replacement of the gift card. Certain Province or State laws do not allow limitation of certain damages. IF these law apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you may have additional rights. 

9. Applicable Law: Gift Cards are issued by BONMATCH, a B.C CANADA limited liability company. When you purchase, receive or redeem a Gift Card, you agree that the laws of the British Columbia, without regard to conflict of laws principles, apply to and govern our Gift Card terms and conditions. We reserve the right to change any of the terms and conditions applicable to Gift Cards at our discretion at any time, subject to applicable laws.

ACCURACY OF BILLING AND ACCOUNT INFORMATION 
Bonmatch reserve the right to refuse any order you place with us. Bonmatch may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Bonmatch may provide you with access to third-party tools over which Bonmatch neither monitor nor have any control nor input. 
You acknowledge and agree that Bonmatch provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. Bonmatch shall have no liability whatsoever arising from or relating to your use of optional third-party tools. 
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). 
Bonmatch may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Bonmatch are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. 

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS 
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. Bonmatch undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. 
In no case shall www.bonmatch.com, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 

INDEMNIFICATION 
You agree to indemnify, defend and hold harmless www.bonmatch.com and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

LIMITED WARRANTY AND RETURNS

BONMATCH offers a limited warranty on our Products. Our product are guaranteed to be free of material defects and each album and book goes through multiple inspections to give the precision and care it deserves. We stand behind the products we create.

Therefore, if there are any issues with the actual manufacturing of the book , please notify us at bmservice@bonmatch.com within ten (10) business days of the order being delivered. Please include your order confirmation number in that email message and, where possible, attach a digital photograph as evidence of the defect or damage.

BONMATCH reserves the right to request the return of the defective Product to verify that such Product is defective and eligible for a return under this limited warranty. There is no redeemable cash value for returned Products. Due to the custom and personalized nature of our Products,

BONMATCH cannot make returns for User-driven mistakes or creative choices. Production begins once we have our customers 100% approval of the final draft/design for their photo album or book. It is important that the Users carefully proof the content and order details of their Products for the following: (1) Product selection mistakes including Product type, size, style, color and design layout;(2) accidental omissions including blank pages or empty photo boxes (3) poor image quality including low resolution images that may be insufficient for print;(4) typo or misspelling, grammar, font choice or other text errors or omissions.

Users should also note that image colors vary from computer monitor to computer monitor. BONMATCH relies on its professionally calibrated printing services and therefore cannot be responsible for color variations that might result from computer screen differences.

CANCELLATIONS

BONMATCH reserve the right to cancel any affected order (regardless of whether you have made payment for that order or not), in its sole discretion, includes objectionable content or that may violate any of the terms of these Terms, without any liability to you or any third party. In the event of such cancellation, you will be refunded for any amount actually received by BONMATCH for the cancelled order, less any applicable fees.

RISK OF LOSS

All Products purchased from or via the Service are transported and delivered to you by an independent carrier not affiliated with, or controlled by, BONMATCH. Title to Products purchased on the Service, as well as the risk of loss for such Products, passes to you when BONMATCH or our supplier delivers these items to the carrier.

We will not be liable for any loss, expense, or other damage caused by any delay in dispatch or delivery. We are not responsible for misdirected shipments or where you have supplied an incorrect, invalid or incomplete delivery address. Once your order has been delivered in accordance with your delivery instructions, you assume full responsibility for and risk in the Products.

PAYMENT INFORMATION

All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. Certain of the Services may allow or require you to save a payment method to be used for future purchases. By signing up for these Services and providing payment details in connection therewith, you consent to BONMATCH storing this payment method and charging such account for future purchases that you approve. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions. You can edit or remove your saved payment methods at any time from your BONMATCH account settings.

STORE CREDIT

For promotional or other purposes, BONMATCH may from time to time add credit to your account (“Store Credit”), and the redemption of such Account Credit is governed by these Terms, including the following:

(1) Store Credit may be redeemed through the BONMATCH website only. Store Credit may not be used toward previous purchases. Every permitted purchase made with Store Credit, plus applicable costs, such as shipping and handling and taxes, is deducted from your Store Credit balance. Store Credit will be applied against the total amount of the order placed.

(2) Store Credit may not be purchased and has no cash value. Store Credit may not be transferred, resold or redeemed for cash or checks, and cannot be transferred to credit card accounts or accounts of other means of payment. Store Credit in an BONMATCH account may not be transferred to another BONMATCH account or split among multiple accounts.

(3) Unless another expiration date is provided, Store Credit will expire one year from the date of issuance. Upon expiration, Store Credit will no longer be available and will not be refunded.

(4) BONMATCH reserves the right to terminate Store Credit, impose or modify expiration dates, and modify conditions for Store Credit, in our sole discretion.

SOCIAL MEDIA AND OTHER SERVICES:

While using our services, you have the option of granting us access to your account(s) with certain third-party social media and other services, such as Facebook, Instagram, Google Photos, Flickr, Twitter, SmugMug, and others (each, an “SNS”). Provided an SNS permits this, we can capture and make available on the Site and through the Apps the photos and other content that you have stored in your account(s) with such SNSs (“SNS Content”). By granting us access to your SNS Content, you understand that we will access, make available and store (if applicable) your SNS Content so that it is available on the Site and through our Apps. We are not responsible for any SNS Content stored on an SNS that you choose to make available on the Site and through our Apps. Depending on the SNS you choose and subject to the privacy settings you have set in your SNS account(s), personally identifiable information that you post to your SNS account(s) will be available on the Site and through our Apps. Please note that if an SNS account becomes unavailable or SNS terminates our access to your SNS account(s), any Content from that SNS may no longer be available on the Site and through our Apps. You have the ability to disable the connection between the Site and Apps and your SNS account(s), at any time, by accessing the “Settings” section of the Site and Apps. PLEASE NOTE THAT YOUR RELATIONSHIP WITH EACH SNS, INCLUDING YOUR RIGHTS WITH RESPECT TO ANY CONTENT THAT YOU PROVIDE TO AN SNS AND THE STORAGE OF SUCH CONTENT, IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH SNS.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. 
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). 

ENTIRE AGREEMENT

These Terms and Conditions apply to the Bonmatch "Early Slow Friday Deal, Early Peace Friday Deal." promotions:

1. The "Early Slow Friday Deal, Early Peace Friday Deal." Promotions will begin at 11:00am (PST) on 5th November 2021 ("Start Date") and closes at 11:59pm (PST) on 27th November 2021 ("End Date"). Discounts will only be valid during this time. Discount cannot be combined with any other discount or promotion or be applied retrospectively.
